The Council’s response to the complaint

  1. The Council provided no formal response to our proposal to undertake this investigation.

The Council’s social worker explained that when she assessed Mrs M’s needs in January 2009, she was considering whether her care needs were met by her current placement: it was an ‘overview’ assessment, not an in-depth study.  If she had considered that there was a need for further medical assessment (which had not been identified by the staff at the Care Home or the GP), she would have ensured that the referral was made.  However, she saw nothing to suggest that Mrs M’s medical and physical needs were not being met.  It seemed clear to her that the case was appropriately placed with the ASC team.
  3. The social worker said that she would have provided assistance in finding a new placement for Mrs M if requested, but was aware that although Mrs M would have liked to live nearer to her daughter, she did not really want to move from the Care Home.  It was clear she had the mental capacity to make that decision.
