Department of Trade and Industry: rejection of late claim for ex gratia payment
Mrs X made a claim to the Department of Trade and Industry for an ex gratia payment in respect of her late husband under a non-statutory redundancy scheme after the scheme had closed. The Department rejected the claim on the grounds that there was no good reason why Mrs X could not have claimed before the scheme's closure. The Ombudsman found no evidence of maladministration in the Department's handling of the claim or in the way they had decided to close the scheme and publicise its closure. The Ombudsman criticised the Department of Trade and Industry's predecessor, the then Employment Department, which had been responsible for setting up the scheme, for poor record-keeping.
