Alleged maladministration in the handling of an application to approve a development of land
Mr W complained that English Partnerships had failed to properly consider objections to a land development proposal near his property. The investigation found that in preparing an application for the authorisation of the development English Partnerships' staff had considered the objections raised, and had included them in the application. It also found that the competent authority in English Partnerships had taken account of the relevant issues. There was no maladministration at either stage.
The land development proposal involved building an extension to the road in which Mr W lived. There was no evidence that English Partnerships had assured Mr W when he bought his property that the road would not be extended or that Mr W or his representative had carried out any pre-purchase searches. Such searches would have shown that a future development was envisaged with access from an extension to the existing road.
