Shortcomings in investigating representations about a person's financial eligibility for legal aid
Over a period of years beginning in 1989 Mr D made representations to the Legal Aid Board alleging that his opponent in legal proceedings was not financially eligible for legal aid. In 1999 the Legal Services Commission revoked the opponent's legal aid certificate. The Ombudsman found that there had been unnecessary delays by the Legal Services Commission in responding properly to Mr D's representations and in arriving at the decision to revoke the certificate. The Chief Executive of the Legal Services Commission apologised and agreed to pay Mr D £60 for additional expenses he had incurred in pursuing the matter with the Legal Services Commission.
