Failure to maintain a security fence
Mr M complained that the Northern Ireland Office had failed to maintain a security fence between his and his former neighbour's property which they had erected in 1983/84 without consulting him. The Northern Ireland Office took the view that their responsibility for the fence had ceased when the former neighbour had sold his property in 1992. The Ombudsman found no evidence that Northern Ireland Office had misled Mr M at the time the fence was erected regarding the repair and maintenance obligations involved, or that they had assumed a liability to him in that respect which they had failed to fulfil. However, he found shortcomings in Northern Ireland Office's handling of Mr M's requests for information on the matter. The Permanent Under Secretary of State of Northern Ireland Office apologised for that and agreed to remind officials of their obligations under the Code of Practice on Access to Government Information.
