Alleged unfair and improper rejection of an application for a Smart award
Mr X complained that the Department of Trade and Industry (DTI) and the Government Office for London had acted unfairly and improperly in rejecting his application for a Smart award; that DTI’s review of the application had not been carried out properly and in accordance with the terms of the review; and that the reviewing officer had told him during a telephone conversation that he had been awarded a grant, but the offer was subsequently withdrawn. The Ombudsman did not uphold Mr X’s complaint that the Government Office had acted unfairly in rejecting his application. While the Ombudsman identified some shortcomings in the reviewing officer’s handling of DTI’s review, there was nothing to show that the review had not been carried out properly and in accordance with the terms of the review. Because of conflicting evidence, the Ombudsman was unable to reach a firm conclusion on exactly what had been said during the telephone conversation.
