DATA PROTECTION REGISTRAR
The conduct by the Data Protection Registrar (DPR) of an investigation into a complaint
A man complained that an investigation by DPR of a complaint that he had breached the Data Protection Act by using his position in a local authority to obtain personal information improperly had been unnecessary, unfair and dilatory. The Ombudsman found no fault with DPR's decision to investigate the matter, and concluded that, although the investigation might have been progressed more quickly at certain stages, the overall time taken to conclude it had not been excessive. There had been some procedural shortcomings in DPR's conduct of an interview with the man, although the questions put at the interview had been justified. The Registrar apologised for the shortcomings identified and undertook to ensure that correct procedures were drawn to the attention of her investigating officers.
