Delay in re-listing an appeal to a social security appeal tribunal
In October 1997 a social security appeal tribunal adjourned Mrs N's appeal against a decision that she could not be treated as incapable of work, so that she could obtain a medical report. Mrs N's representative sent the Independent Tribunal Service (ITS) a copy of the medical report in November 1997 and asked ITS to arrange a new hearing date. In May 1998 ITS were unable to trace Mrs N's papers. Mrs N's representative sent copies of his own papers to ITS. He sent another set of copies in March 1999. The tribunal heard Mrs N's appeal in April and found in her favour. ITS made an ex gratia payment of £150 as compensation for inconvenience. They asked the Benefits Agency to make a compensatory payment for loss of use of benefit. ITS also described planned improvements to working practices and post handling.
