The handling of applications for listed building consent
The Ombudsman found no evidence that English Heritage (EH) had acted with maladministration in making a discretionary decision to require the imposition of conditions on the complainant's original application for listed building consent or that they had delayed giving directions on two other applications he had made. The Ombudsman criticised EH for either not replying, or not replying sooner, to reminders from the local authority about those applications, for not acting promptly on a notification that the complainant had appealed, and for not replying to a letter from the complainant. Although responsibility for the proper progress of the complainant's applications had lain with the local authority, in the absence of maladministration by EH there might have been no need for the complainant to appeal to obtain the listed building consent he required. EH's Director of Corporate Services offered his apologies for the shortcomings which the Ombudsman had identified and agreed EH would meet those expenses the complainant had incurred in the pursuit of his appeals which had not already been paid by the local authority.
