Misdirection by the Benefits Agency concerning entitlement to industrial injuries disablement benefit
In November 1979 Mr G suffered an industrial accident. In March the following year he visited a local office of the Benefits Agency (BA) where he was given misleading advice as to his eligibility to claim industrial injuries disablement benefit (IIDB) in respect of the accident. That caused him to delay making claims for IIDB, special hardship allowance and reduced earnings allowance in respect of the accident. As a result he received those benefits later than he should have done. In the light of the Ombudsman's findings, BA agreed to make Mr G an ex gratia payment of £8,778.99 by way of compensation for the period of loss of use of those benefits.
