Handling of water quality issues at a watersports centre
Mr P complained to the English Sports Council (ESC) that, when he had taken a group of pupils to use the canoe slalom course at the ESC's centre in October 1994, they had later become ill because of the poor quality of the water. He contended that ESC had failed to manage the centre properly, and failed both to respond to complaints from users and to inform users adequately about the risks of swallowing or inhaling water. The Ombudsman found no evidence that, before 1994, ESC had sought to deny problems of water pollution, or to mislead course users. By the time Mr P had visited the course in October 1994 the presence of bacteria in the water and the attendant risk of illness was being brought to the attention of canoeists through signs and leaflets. The Ombudsman also found that, since 1994, ESC had taken steps to warn users of the risks of illness, to report incidences of illness to the health authorities and to monitor water quality.
