Quota arrangements for the employment of registered disabled persons
Mr D a registered disabled person, complained that ES had issued widespread bulk permits which allowed employers to engage persons not registered disabled to fill vacancies for which he was suitably qualified. He cited particular instances involving his local district council, a magistrates court committee and a registered charity whose activities were not adequately checked. The Ombudsman found a number of serious errors in the handling of these and other matters complained of. He upheld Mr D's complaint and criticised ES for their failure to apply sufficient controls to the issuing of permits and for their poor monitoring of certain employers. But for those errors Mr D may well have found work. The ES Chief Executive apologised to Mr D and agreed to make him an ex gratia payment of £20,000 to compensate for the loss of employment opportunities and the prolonged distress so caused.
