Benefits Agency: misdirection on entitlement to a retirement pension and refusal to pay interest
In 1982, when aged 60, Mrs L was wrongly told that she had no pension entitlement although the record of her national insurance contributions showed that she had paid graduated contributions. Mrs L again claimed retirement pension in 1996. The Benefits Agency awarded her graduated retirement benefit backdated for 12 months. After exhaustive enquiries the Agency subsequently accepted that she was entitled to a basic pension backdated to November 1995 and paid her £2,279.39 in arrears. Following enquiries about her employment history, the Agency agreed that she had been entitled to a pension from September 1985 to June 1986, while she had a break in employment, and from January 1987 onwards. They paid her a further £8,176.39 equivalent to the pension she had foregone. The Agency initially refused to pay interest for loss of use but after further representations they paid interest totalling £2,771.71.
