Benefits Agency, Independent Tribunal Service and the Office of the Social Security Commissioners: delay in determining a claim to disability living allowance with consequent delay in paying other linked benefits and premiums
Mr X complained that the Benefits Agency, the Independent Tribunal Service, and the Office of the Social Security Commissioners delayed the determination of his successful claim to disability living allowance, which in turn had delayed the payment of other benefits and premiums to him and others in his household, which were dependent on his entitlement to disability living allowance. The Ombudsman upheld Mr X's complaint and as a result the Benefits Agency agreed to make special payments on behalf of the departments involved to Mr X and his household amounting to £4,141.21. That represented their collective loss of use of the arrears of benefit and a consolatory payment to Mr X of £150 in respect of the inconvenience he had suffered as a result of the poor handling of his case.
